New Recording Fees Effective January 1, 2016

Effective January 1, 2015 there will be changes in the recording fees and mortgage registration tax for the Register of Deeds offices across the state (K.S.A. 28-115) and will continue to increase each year through January 1, 2018. The changes are outlined below:

*Mortgage registration tax is changed from 0.20% to .0015%.
*Recording fees will increase - see the Fee Schedule on our website.
*A cap on recording fees for mortgages of $75,000 or less has been set at $125 provided the following requirements are met:
  • The mortgage must apply to a single family residence
  • The residence must be the principal residence of the mortgagor
  • The mortgage must be $75,000 or LESS
This cap applies to recording fees ONLY. The mortgage registration tax will still apply and is not included in the fee cap. An affidavit provided by the SUBMITTER must accompany the mortgage verifying that the mortgage meets the above requirements or full recording fees will be collected. It is NOT the responsibility of this office to determine if a mortgage qualifies for the recording cap. 
  • Affidavits concerning mortgages $75,000 or less and Mortgage Registration Tax Affidavits will now become a part of the document and recording fees will be collected for these affidavits.
All changes will take effect January 1, 2015. As the end of year approaches, please keep in mind the fees will be based on the date that the documents are received in our office, not the date the documents are executed.
